Children, who were not happy with the decision of their elderly father to leave his estate exclusively to some of his other children, decided to challenge the will. They claimed that the elderly father (in his nineties) was unduly influenced by his son with whom he lived. After all the facts were presented by John Booth Farese, the Chancellor ruled that the father was competent to make a will and was not unduly influence by his son. The Mississippi Supreme Court agreed and affirmed the decision in Miner v. Bertasi, 530 So. 2d 168 (8/10/88).
